White House Protest Will Counter Obama-Saudi Campaign to Kill 9/11 Lawsuit Bill

White HouseAs the Obama administration and the Saudi government lobby Congress to prevent an override of the president’s promised veto of a bill that would enable 9/11 lawsuits against the kingdom, family members are organizing a White House protest of that veto for this Tuesday.

9/11 family members, survivors and other concerned citizens will convene near the White House at Lafayette Square on Tuesday, September 20 at 12:30 pm and organizers are arranging for bus transportation. If you can join them, you’re encouraged to sign up at passJASTA.org (whether you need transportation or not).

Effort to Kill 9/11 Bill Quietly Strengthens

The bill at the center of this controversy is the Justice Against Sponsors of Terrorism Act (JASTA), which has now passed both the Senate and House via unanimous voice votes. President Obama has until Friday, September 23 to veto the measure, and appears likely to use all of that time to lobby lawmakers against overriding him.

With Congress poised to go on a lengthy election-season recess, the delay could also prevent the override vote from happening until much later this year, when legislators won’t face voter retaliation if they help Obama kill the measure.

The New York Times reported yesterday that “already, cracks are showing, even among Republicans who generally would love to exercise the first veto override against Mr. Obama.” One of those wavering Republicans is Tennessee senator Bob Corker, who told the Times that passing the law would encourage other countries to reciprocate, exposing the U.S. government to suits filed by family members of innocent victims of U.S. drone strikes.

Since he isn’t up for re-election this year, Corker is a logical point man for Republicans who are sympathetic to the administration’s drive to kill the bill. Corker has also supported Saudi Arabia’s U.S.-facilitated war in Yemen, which is creating mass suffering among Yemen’s population while strengthening al-Qaeda’s position in the country.

In July, 28 long-classified pages from a 2002 congressional intelligence inquiry into 9/11 were declassified. They catalog dozens of inter-connections between Saudi government employees, suspected intelligence operatives, al-Qaeda associates and individuals who aided the 9/11 hijackers. Some of the most important revelations concerned the then-Saudi ambassador to the United States, Prince Bandar bin Sultan.

9/11 Commission’s Bob Kerrey Supports JASTA

In a piece for The Hill yesterday, former senator and 9/11 Commission member Bob Kerrey fully endorsed JASTA, declaring that “signing this bill into law will be an act of justice and will help make the United States homeland a safer place to live.”

He also refuted repeated claims by the Obama administration and the Saudi kingdom that the 9/11 Commission report is evidence of Saudi Arabia’s innocence. “This is not true.  It is true that the Commission did not conclude that the Saudis were guilty but we most definitely did not conclude that they were not involved.  In fact there was considerable evidence suggesting just the opposite,” wrote Kerrey.

9/11 Families to Attend Speaker Ryan’s Memorial Event…to Either Thank Him or Condemn Him

On Friday at 10:30am, Speaker of the House Paul Ryan and House Majority Leader Nancy Pelosi will host a 9/11 memorial event on the Capitol steps.

9/11 family members, survivors and other citizens are planning to be there too. Depending on Ryan’s actions this week with the Justice Against Sponsors of Terrorism Act (JASTA), their purpose will either be to publicly thank him for scheduling a vote on the measure or to publicly reprimand him for failing to do so.

The Justice Against Sponsors of Terrorism Act (JASTA) would modify U.S. sovereign immunity laws in a way that would clear the path for the families and surviving victims of the attacks to sue Saudi Arabia. It passed the Senate by unanimous voice vote, but now requires a vote in the House of Representatives.

Kathy Owens, who lost her husband Peter in the attacks and is helping to organize Friday’s activism, says it’s difficult to watch elected officials commemorate the attacks while continuing to shield Saudi Arabia from facing 9/11 families in court.

“It’s outrageous that they would say they’re honoring the victims when they have been blocking justice for them. It’s really hypocrisy for them to attend ceremonies and make speeches about 9/11 victims when after 15 years there’s been no justice or accountability,” Owens said.

Through the discovery process associated with a court case, the judicial branch may be our best shot to pry these documents loose and bring the full truth about Saudi links to 9/11 to light.

In an appearance this morning at the National Press Club, former Senate intelligence committee chairman Bob Graham said the July release of 28 pages from a 2002 congressional inquiry was just the first step toward gaining full transparency on the U.S. government’s investigation of Saudi links to the 9/11 attacks.

“This is removing the cork from the bottle,” said Graham. “There is a significant amount of information which, like the 28 pages, has been withheld and it was necessary to get this first block of material to the public in order to build the support that will be necessary for the balance of the material to flow.”

Pattern of “Aggressive Deception”

Among the countless documents still hidden from public view are those relating to the FBI’s investigation of a wealthy, well-connected Saudi family in Sarasota that reportedly had many contacts with future 9/11 attackers before suddenly vacating its home days before the attacks.

The FBI initially denied that it had any documentation of that investigation. When pressed with a Freedom of Information Act lawsuit, the bureau surrendered 80,000 pages of documents to a federal judge who is currently reviewing them for potential release.

Graham characterized the FBI as moving beyond a cover-up, which he defined as a passive withholding of information, to “aggressive deception” in which “they rewrote the narrative,” making public declarations that are at odds with what’s contained in the bureau’s still-secret documents.

Noting that there were several al Qaeda cells around the country, Graham called for the release of still-classified files from the investigations of hijackers based in New Jersey and Virginia, as well as additional material from the 9/11 Commission.

Those commission documents are vital to helping the American public understand the apparent disconnect between the commission’s conclusions that it found no evidence of Saudi government support of the 9/11 plotters and disturbing declarations in the newly-released 28 pages—including revelations that an al Qaeda operative in Pakistan had an unlisted phone number associated with Saudi Prince Bandar bin Sultan’s Aspen, Colorado mansion, as well as the phone number of a bodyguard at the Saudi embassy in Washington, D.C.

Pending Legislation Would Help Cause of Transparency

Graham also endorsed the Justice Against Sponsors of Terrorism Act (JASTA), which would modify the Foreign Sovereign Immunities Act in a way that would clear the path for 9/11 families to sue the Kingdom of Saudi Arabia for its alleged links to the attacks.

Graham positioned the lawsuit as a critical avenue of transparency. Noting that he was familiar with much of the research that plaintiffs’ attorneys had already conducted, Graham said “of all the channels of information about the Saudi role, what’s going to come out in that litigation—if it is allowed to occur because the sovereign immunity defense has been modified—will be astounding.”

JASTA passed the Senate unanimously in May, and activist 9/11 family members and victims are pressing Speaker of the House Paul Ryan to schedule a vote immediately upon Congress’s return from summer recess next week. The activists’ latest efforts include emotionally impactful videos recorded by those directly and indirectly affected by the attacks, as well as a letter from the children of many who were slain in the attacks.

Graham said his daughter, Florida Congresswoman Gwen Graham, has observed an increase in constituent support for JASTA following the release of the 28 pages, adding, “I hope that (the House) will act during this session, ideally before the fifteenth anniversary of 9/11.”

The Saudi government promptly responded to Graham’s remarks, declaring in a press release its “strong disappointment at Senator Graham’s continued advocacy of the idea that the government of Saudi Arabia bore responsibility for the attacks of September 11, 2001.”

As the fifteenth anniversary of the 9/11 attacks draws closer, family members of those lost in the attacks are making an emotional appeal to Congress to clear the way for their lawsuit against the Kingdom of Saudi Arabia for its alleged financial and logistical support of the hijackers.

In an effort led by the September 11th Advocates—five women who lost loved ones in the attacks—surviving family members and other concerned members of the public are posting videos to a Facebook page and a YouTube channel in which they urge the House of Representatives to promptly pass the Justice Against Sponsors of Terrorism Act (JASTA) when they return from summer recess on Tuesday, September 6.

Adjusting Sovereign Immunity Laws

The bill, which would modify U.S. sovereign immunity law to allow suits against foreign government sponsors of terrorism, passed the Senate by unanimous voice vote. Now, the September 11th Advocates are pressing Speaker of the House Paul Ryan and House Majority Leader Kevin McCarthy to schedule a vote on the measure before the 15th anniversary of the attacks.

“We believe that 15 years is long enough and it would honor our loved ones if they would pass JASTA and allow us to proceed with our path to justice and holding the Saudis accountable for their alleged role,” the group’s Kristen Breitweiser tells 28Pages.org. Breitweiser’s husband, Ron, was killed at the World Trade Center. She and fellow September 11th Advocates Patty Casazza, Monica Gabrielle, Mindy Kleinberg and Lorie Van Auken have been leading advocates for 9/11 transparency.

Though the measure passed the Senate unanimously, Breitweiser says JASTA faces formidable opposition down the stretch. Saudi Arabia has warned Congress and the White House that it may be compelled to divest upwards of a $750 billion dollars in U.S. assets if the measure passes, and President Obama has expressed reluctance to sign the bill if it advances to his desk.

“The reality is that the Saudis throw a lot of money around Washington, D.C. and they have a lot of influence. The Saudis have the president and the State Department on their side. I think that’s un-American, I think it’s unpatriotic, I think it’s disgusting, frankly. I don’t know how President Obama will be able to commemorate the 9/11 attacks, by giving a speech or laying a wreath or what have you, when he stabbed the 9/11 families in the back by supporting the Saudis over the 9/11 families,” says Breitweiser.

Civil Suit Could Bring New Evidence to Light

In July, Congress released 28 long-classified pages from a 2002 congressional inquiry into 9/11. The pages—which contained 97 redactions—revealed substantial new clues pointing toward Saudi connections to the hijackers. The Obama administration downplayed those clues, claiming that the 9/11 Commission thoroughly investigated them and found no Saudi government sponsorship of the attacks.

Breitweiser doesn’t buy it. “You’ve got plenty of information out there that the 9/11 Commission did not do a full investigation of the Saudis. Several 9/11 Commissioners themselves acknowledge that. Whether you want to talk about the budget, whether you want to talk about the way (9/11 Commission executive director) Philip Zelikow set it up, it was not a full investigation. That’s one of the reasons why we’re fighting for JASTA, because at least in a court system we’ll have discovery and more than anything we want the American public to see the evidence and see the information and be fully engaged and educated on the issue.”

First, though, they have to persuade the House and Obama to enact JASTA. The video project reinforces that family members and friends of those killed in the attacks are victims of a crime who deserve their day in court. “We wanted to make sure that every 9/11 family member would have their voice heard by every member of Congress, because we think 15 years is long enough and justice delayed is justice denied. We don’t have thousands of dollars to plunk down to sit next to Speaker Ryan at a campaign dinner, but we do have iPhones,” says Breitweiser.

Nearly 15 years after the shocking loss of her husband, her patience is running thin: “I’m really aggravated that my husband and 3,000 people were brutally murdered and my government has no interest in holding anyone accountable for it…I want to know that my husband’s life was not lost in vain.”
